Agreement
THIS AGREEMENT "Agreement"
is entered into by and between 4 Jobs Online Limited and any individual,
corporation, association, agency, company, or other entity who accesses or uses
the internet website www.4eujobs.com owned by 4 Jobs Online
Limited (the "User" or "you").
www.4eujobs.com
is a World Wide Web site on the Internet that is designed to allow users to
post ads/CV's and/or to view ads/CV's posted by other users or interact with
those users. www.4eujobs.com contains or may contain information,
communications, opinions, text, graphics, links, electronic art, animations,
audio, video, software, photos, music, sounds and other material and data (collectively,
"Content") formatted, organized and collected in a variety of forms that are
generally accessible to Users, including directories and databases, and areas
of www.4eujobs.com that can be modified by Users, such as posting
ads, uploading files, registering user profiles, and creating JobMail/CVMail
profiles ("Interactive Areas").

1. User Rights and
Responsibilities:

are responsible for all Internet access charges, telephone charges or other
fees or charges incurred in connecting to the Internet and accessing www.4eujobs.com .
1.2 User Conduct:
You agree to access
and use 4 Jobs Online Limited only for lawful purposes. You are solely
responsible for the knowledge of and adherence to any and all laws, statutes,
rules and regulations, pertaining to (i) your use of the www.4eujobs.com ,
including any Interactive Area, (ii) the use of any networks or other services
connected to the 4 Jobs Online Limited, and (iii) the communications
means by which you connect your modem, computer, or other equipment to www.4eujobs.com. By accessing www.4eujobs.com , you agree
that you will not:
(1.2.1) restrict or inhibit any other user from using and enjoying the Interactive
Features;
(1.2.2) post or transmit any unlawful, threatening, abusive, libellous, defamatory,
obscene, vulgar, pornographic, profane, or indecent information of any kind,
including without limitation any transmissions constituting or encouraging conduct
that would constitute a criminal offence, give rise to civil liability or otherwise
violate any local, state, national, or international law;
(1.2.3) post or transmit any information, software, or other material which
violates or infringes in the rights of others, including material which is an
invasion of privacy or publicity rights or which is protected by copyright,
trademark or other proprietary right, or derivative works with respect thereto,
without first obtaining permission from the owner or right holder.

a virus or other harmful component;
(1.2.5) alter, damage or delete any Content or other communications that are
not your own Content or to otherwise interfere with the ability of others to

(1.2.7) claim a relationship with or to speak for any business, association,
institution or other organization for which you are not authorized to claim
such a relationship;
(1.2.8) violate any operating rule, policy or guideline of your Internet access
provider or online service.

2. Intellectual
Property Rights:
2.1 4 Jobs Online Limited

Website Content:
(a) You acknowledge that
Content on the 4 Jobs Online Limited website is generally provided by
the 4 Jobs Online Limited, individual contributors of Content ("Contributors"),
third party licensees, and/or other Users. You acknowledge that 4 Jobs Online Limited
permits access to Content that is protected by copyrights,
trademarks, and other proprietary (including intellectual property) rights ("Intellectual
Property Rights"), and that these Intellectual Property Rights are valid and
protected in all media existing now or later developed and except as is explicitly
provided below, your use of Content shall be governed by applicable copyright
and other intellectual property laws. You acknowledge that 4 Jobs Online
Limited owns a copyright in the "look and feel," i.e., the selection, coordination,
arrangement and presentation of such Content.
(b) You may not modify, copy, reproduce, transmit, distribute, publish, create
derivative works from, display or otherwise transfer or commercially exploit
any of the Content, in whole or in part, provided, however, that you may (i)
make a reasonable number of digital or other form of copies to permit your computer
hardware and software to access and view the Content, (ii) print one copy of
each piece of Content, (iii) make and distribute a reasonable number of copies
of Content, in whole or in part, in hard copy or electronic form for internal
use only. Any permitted copies of Content must reproduce in an unmodified form
any notices contained in the Content, such as all Intellectual Property Right
notices, and an original source attribution to "www.4eujobs.com"
and its URL address. You acknowledge that the 4 Jobs Online Limited,
its Contributors, and/or Users remain the owners of the Content and that you
do not acquire any Intellectual Property Rights by downloading or printing Content.
2.2 Content Provided By User:
You may upload to any Interactive
Area or otherwise transmit, post, publish,reproduce or distribute, on or through
www.4eujobs.com only Content that is not subject to any Intellectual
Property Rights, or Content in which any holder of Intellectual Property Rights
has given express authorization for distribution over the Internet and on www.4eujobs.com ,
without restriction whatsoever. Any Content submitted with the consent of a
copyright owner other than you should contain a phrase such as "Copyright owned
by [name of owner]; Used by Permission." By submitting Content to any Interactive
Area, you automatically grant and/or warrant that the owner of such Content,
whether it be You or a third party, has expressly granted 4 Jobs Online
Limited the royalty-free, perpetual, irrevocable, non-exclusive, unrestricted,
worldwide right and license to use, reproduce, modify, adapt, publish, translate,
create derivative works from, sublicense, distribute, perform, and display such
Content, in whole or in part, worldwide and/or to incorporate it in other works
in any form, media, or technology now known or later developed for the full
term of any Intellectual Property Rights that may exist in such Content. You
also permit 4 Jobs Online Limited to sublicense to third parties the
unrestricted right to exercise any of the foregoing rights granted with respect
to such Content. You also permit any User to access, view, store and reproduce
the Content for personal use.

3. Interactive Areas:
You acknowledge
that 4 Jobs Online Limited may include various interactive areas ("Interactive
Areas"), including but not limited to ads. These Interactive Areas allow feedback
to 4 Jobs Online Limited and interaction between users. You further understand
that 4 Jobs Online Limited does not control the messages, information,
or files delivered to such Interactive Areas and that 4 Jobs Online Limited
may offer you and other Users the capability of creating and managing an Interactive
Area. 4 Jobs Online Limited is not responsible for Content within any
Interactive Area. Your use and/or management of an Interactive Area will be
governed by this Agreement and any additional rules or operating procedures
of any Interactive Area established by you or another User, as applicable. Although
4 Jobs Online Limited previews all ads placed, you should recognize that
4 Jobs Online Limited cannot, and does not intend to, screen communications
in advance. Moreover, because 4 Jobs Online Limited encourages open and
candid communication in the Interactive Areas, 4 Jobs Online Limited
cannot determine in advance the accuracy or conformance to this Agreement of
any Content transmitted in an Interactive Area. 4 Jobs Online Limited
is not responsible for screening, policing, editing, reviewing or monitoring
any Content in an Interactive Area. Notwithstanding the above, you agree that
4 Jobs Online Limited has the right to monitor any Interactive Area,
from time to time and to disclose any information as necessary to satisfy any
law, regulation or other governmental request, to operate the Interactive Area,
or to protect itself or other Users. If notified of Content that is alleged
not to conform to this Agreement, 4 Jobs Online Limited may investigate
the allegation and determine in its sole discretion whether to remove or request
the User to remove such Content. 4 Jobs Online Limited reserves the right
to prohibit conduct, communication or Content within an Interactive Area, or
to edit, refuse to post, or to remove any Content, in whole or in part, which
it deems in its sole discretion to (i) violate the then-standard provisions
of this Agreement or any other standard, written 4 Jobs Online Limited
policy in effect at that time, (ii) be harmful to the rights of any User, the
4 Jobs Online Limited, or other third parties, (iii) violate applicable
law, or (iv) be otherwise objectionable.

4. Cancellation/Refund
Policy:
If you are dissatisfied
with 4 Jobs Online Limited for any reason you may request a refund within
7 working days from the date of invoice. To request a refund please contact
4 Jobs Online Limited, by email or post, with the reasons for your cancellation
plus a copy of your user registration details and a copy of your invoice. The
user registration details are sent to the user upon joining
4 Jobs Online Limited. When payment is made to 4 Jobs Online Limited
by credit card, 4 Jobs Online Limited will refund in full any payments
to the Users credit card. All refunds will be made within 30 days of the users
written cancellation.

5. Termination:
4 Jobs Online
Limited may terminate or temporarily suspend your access to all or any part
of www.4eujobs.com , without notice, for conduct that 4 Jobs Online
Limited believes is a violation of this Agreement or any policies or guidelines
posted by 4 Jobs Online Limited, or for other conduct which 4 Jobs Online Limited
believes, in its sole discretion, is harmful to 4 Jobs Online Limited or other Users.

6. Links:
You understand that
except for Content, products or services expressly available at www.4eujobs.com ,
neither 4 Jobs Online Limited or affiliate companies, controls, provides,
or is responsible for any Content, goods or services available through sites
on the Internet linked to or from www.4eujobs.com . All such Content,
goods and services are made accessible on the Internet by independent third
parties and are not part of 4 Jobs Online Limited or controlled by 4
Jobs Online Limited. 4 Jobs Online Limited neither endorses nor
is responsible for the accuracy, completeness, usefulness, quality or availability
of any Content, goods or services available on any site linked to or from www.4eujobs.com,
which are the sole responsibility of such independent third parties, and your
use thereof is solely at your own risk. Neither 4 Jobs Online Limited
or affiliates shall be held responsible or liable, directly or indirectly, for
any loss or damage caused or alleged to have been caused by your use of or reliance
on any Content, goods or services available on any site linked to or from www.4eujobs.com
or your inability to access the Internet or any site linked to or from 4 Jobs Online

Warranties:

not to endorse or oppose any opinion expressed by a User or Content provided
by a User, Contributor, or other independent party. 4 Jobs Online Limited
will however investigate any complaints made regarding any aspect of www.4eujobs.com
and its content.

8. Limitations On
Liabilities:
(8.1) 4 Jobs Online
Limited shall have no Liability for any defect in the Service caused or contributed
to by You and/or any other Member.
(8.2) 4 Jobs Online Limited shall have no Liability to You if any monies
owed by You to Us have not been paid in full by the due date for payment.
(8.3) The User shall give 4 Jobs Online Limited a reasonable opportunity
to remedy any matter for which We are liable before You incur any costs and/or
expenses in remedying the matter Yourself. If You do not do so We shall have
no Liability to You.
(8.4) The User shall produce to 4 Jobs Online Limited written evidence
of any claims for which it is alleged that 4 Jobs Online Limited are
liable together with written details of how any loss was caused by Us and the
steps you have taken to mitigate the loss before 4 Jobs Online Limited
shall have any Liability for the claim by You.
(8.5) 4 Jobs Online Limited shall have no Liability to You to the extent
that You are covered by any policy of insurance and You shall ensure that Your
insurers waive any and all rights of subrogation they may have against Us.
(8.6) 4 Jobs Online Limited shall have no Liability to You arising out
of Your use of the Service and/or Your reliance on any information and/or other
material Posted on the Service or Posted to You by other Members.
(8.7) It is possible for other Members and/or unauthorised users to obtain and
misuse information about You as a result of Your use of the Service. We shall
have no Liability to You arising out of any Member's and/or unauthorised user's
misuse of information and/or other material Posted by You on the Service and/or
to other Members.
(8.8) 4 Jobs Online Limited shall have no Liability to You for any:-
(8.8.1) consequential losses (including but not limited to loss of profits,
damage to goodwill, loss of data, loss of programs and/or service interruptions);
(8.8.2) economic and/or other similar losses; and/or
(8.8.3) special damages and indirect losses.
(8.9) You shall be under a duty to mitigate any loss, damage, costs or expenses
that You may suffer.
(8.10) Our total Liability to You under and/or arising in relation to any Contract
shall not exceed 2 times the amount paid by you for the Service (if any) under
that Contract or the sum of £100, whichever is the higher.
(8.11) Each of the limitations and/or exclusions in this Agreement shall be
deemed to be repeated and apply as a separate provision for each of:
(8.11.1) Liability for breach of contract;
(8.11.2) Liability in tort (including negligence); and
(8.11.3) Liability for breach of statutory duty; except clause 8.10 above which
shall apply once only in respect of all the said types of Liability.
(8.12) Nothing in this Agreement shall exclude or limit Our Liability for death
or personal injury due to Our negligence or any Liability which is due to Our
fraud or any other Liability which it is not permitted to exclude or limit as
a matter of law.
(8.13) Nothing in this Contract shall exclude or limit any of Your statutory
rights which may not be excluded or limited due to You acting as a consumer.
(8.14) We shall have no Liability to You for any delay in performance of this
Service and/or any other matters to the extent that such events and/or matters
are due to any events outside Our reasonable control including but not limited
to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots,
civil commotion, malicious damage, explosion, governmental actions and any other
similar events.

9. Indemnity:
The user agrees
to indemnify and keep indemnified 4 Jobs Online Limited against any and
all losses, proceedings, lost profits, damages, awards, expenses, costs (including
increased administration costs and legal costs on a full indemnity basis), claims,
actions and any other losses and/or liabilities suffered by Us and arising from and/or
relating to Your use of the Service, information and/or other material Posted
on the Service by You and/or arising from or due to any breach of contract,
any tortious act and/or omission and/or any breach of statutory duty by You.

10. Miscellaneous:
(10.1) This Agreement
is governed by and interpreted in accordance with the Law of England and Wales
and the parties agree to submit to the non-exclusive jurisdiction of the English
courts.
(10.2) 4 Jobs Online Limited may revise this Agreement or any other policy
at any time and from time to time, and such revision shall be effective two
(2) days upon posting notice of such revision prominently on www.4eujobs.com
. You agree to review this Agreement periodically to be aware of such revisions.
If any such revision is unacceptable to you, you must discontinue accessing
www.4eujobs.com . Your continued accessing and use of www.4eujobs.com
following notice of any such revision shall conclusively be deemed acceptance
of all such revisions.
(10.3) The provisions of Sections 1.2, 2.1, 2.2, 6, 7, 8, 9 and 10 shall survive
the termination or expiration of this Agreement.
(10.4) The failure of 4 Jobs Online Limited to insist upon or enforce
strict performance of any provision of this Agreement shall not be construed
as a waiver of any provision or right.
(10.5) All logos, brand names, products, trademarks and service marks appearing
herein may be the trademarks or service marks of their respective owners. References
to any trademark, service mark and links to or from www.4eujobs.com
have been done strictly for clarification and identification and does not constitute
endorsement by 4 Jobs Online Limited of the products, services or information
offered by the owner of such trademark, service mark or link or endorsement
of 4 Jobs Online Limited by such trademark, service mark or link owner.
(10.6) 4 Jobs Online Limited are permitted to use and edit all logos, brandnames, products, trademarks and service mark, to ensure compatibility and coherence with the functionality of any websites owned by 4 Jobs Online Limited.
(10.7) www.4eujobs.com is committed to EU recruitment. As specialists
we provide a more focused service, 4 Jobs Online Limited understands
jobs markets, we understand that companies want a focused service
to attract quality candidates to their vacancies. 4 Jobs Online
Limited is always striving to improve the quality of the Jobs and
jobseekers on this website. 4 Jobs Online Limited reserves the right
to exclude or cancel any CV or job vacancy displayed on the site
which is not related to EU jobs.
(10.9) FAIR USE POLICY:
We want you to benefit from the "Unlimited" services we
provide across the 4 Jobs Online Network. But as you'll understand
we need to manage this, so here are a few things you should know:
(10.9.1) Unlimited Job Posting:
Fair Use Limit: 1000 job postings per month.
That's more than 30 each and every day. From our experience of hundreds
of recruiters and their posting habits, 1000 job postings per month
should more than cover your posting needs. We monitor the posting
behaviour of all recruiters and will permit posting in excess of
1000 jobs per month, but this is to be agreed on a case by case
basis. We will email you to discuss your account when your Fair
Use Limit is exceeded.
(10.9.2) Unlimited CV/Resume Downloads:
Fair Use Limit: Unlimited.
We do permit unlimited access to our CV/Resume Database. This access
is granted for your own professional use and does not grant you
the right to resell or otherwise redistribute any CV's downloaded
from our database. We have placed some traceable CV's in our database
to monitor for this. In the event of a complaint from any registered
jobseeker we reserve the right to investigate the complaint and
limit or terminate your access to our Database/website.
We will email you to discuss any such matter prior to changing your
access.
(10.9.3) Multiple Job Locations:
Fair Use Limit: 10 locations per job.
We are aware that national companies need to recruit for some or
all of their offices, and a separate location in each job advert
is necessary. There may be occasions when you will need more than
10 locations. This is permitted if we can see from your advert that
there is a place of work (Office / Retail / Industrial / Commercial
Premises) associated with the vacancy.
Our Fair Use Limit for Multiple Locations permits us to stop "Work
From Home", "Franchise Opportunities" and the like,
from bulk advertising across our job site. If your company requires
employees to work from their home location, we
recommend you advertise your job and restrict the jobs location
to a specified country. You should also ensure the job description
explains where the jobseeker will be working. Repeating
a job vacancy on a location by location basis will be considered
an unfair use of our services and will result in your account suspension.
We will email you to discuss your account when this Fair Use Limit
is in question.
(10.9.4) Multiple
Job Categories / Sub-Categories:
Fair Use Limit: 5 per job.
We have tailored our Categories and Sub-Categories to best reflect
the specialisations associated with each profession. There may be
occasions when your Job advert could be equally suited for 2 or
more job categories/ sub-categories. In such a case you are permitted
to duplicate your job advert if you have sufficient job credits.
Our Fair Use Limit for Multiple Categories/ Sub Categories permits
us to stop any "Off-Topic" postings. Repeating your job
advert across multiple categories/ sub-categories which are not
directly related to your job advert will be considered an unfair
use of our services and will result in your account suspension.
We will email you to discuss your account when this Fair Use Limit
is in question.
